User Agreement

These Terms are a binding agreement between you and Pockeex Company (“Pockeex”, “we”, “us”) governing your use of pockeex.cc and related services (the “Service”). By creating an account or using the Service, you accept these Terms.

1. Eligibility & account

You must be at least 16 and able to form a binding contract. You are responsible for your account, credentials, and all activity under it. Keep your password secure and notify us of any unauthorised use.

2. The Service

Pockeex is an AI assistant that generates text and analyses images using third-party AI models. The Service is provided as an evolving, beta/experimental product and may change, be limited, or be discontinued at any time.

3. Acceptable use

You agree not to: (a) use the Service unlawfully or to produce illegal, harmful, or infringing content; (b) attempt to extract, resell, or proxy our API keys or model access; (c) scrape, overload, reverse-engineer, or circumvent security or usage controls (including the per-message character limit); (d) automate or share access to abuse the flat-rate model. We may suspend or terminate accounts that breach these rules.

4. AI output disclaimer

AI responses may be inaccurate, incomplete, or unsuitable for your purpose and do not constitute professional (legal, medical, financial, etc.) advice. You are solely responsible for how you use any output and for verifying it before relying on it.

5. Subscriptions & billing

Paid plans are billed in advance at the price shown for your language/currency (charged in EUR €5.49/month equivalent) through our processor Creem, and renew automatically each period until cancelled. Taxes may apply. We may change prices with reasonable prior notice, effective on your next renewal.

6. Cancellation & refunds

You may cancel at any time as described in our Cancellation Policy, which forms part of these Terms.

7. Intellectual property

The Service, its software, design, and branding are owned by us or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service. As between you and us, you retain your own inputs.

8. Availability — no guarantee

The Service is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, secure, or error-free, and we are not responsible for temporary malfunctions, unavailability, downtime, delays, data loss, or deficiencies of the Service, including those caused by third-party providers (AI models, payment, hosting) or events beyond our reasonable control.

9. Limitation of liability

To the maximum extent permitted by law: (a) we exclude all implied warranties; (b) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill; and (c) our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

10. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control (including outages of third-party providers, network failures, cyber-attacks, or legal changes).

11. Indemnity

You agree to indemnify us against claims arising from your unlawful use of the Service or breach of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, suspected abuse, or legal/operational reasons. Sections that by nature should survive termination (e.g. 4, 7–14) survive.

13. Governing law

These Terms are governed by the laws of Republic of Poland, without prejudice to the mandatory consumer-protection rights you enjoy in your country of residence. Disputes are subject to the courts of Republic of Poland, subject to any mandatory rules allowing consumers to sue locally.

14. Mandatory rights preserved (savings clause)

Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud, and non-waivable statutory consumer rights. Where any provision is found unenforceable, it is reduced to the minimum extent necessary and the remainder stays in force.
